Terms of Service

By creating an account, continuing as a guest, or using Spiritful (the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. Before your first conversation with the Agent, we also ask you to confirm your acceptance of these Terms and the Privacy Policy with a clear action. In these Terms, "we", "us", and "our" mean Breakinsoft.

Spiritful lets you talk with an AI companion (the "Agent") and use related features such as activities and periodic insights. The Agent builds a Context from your conversations so it can accompany you better, as described in the Privacy Policy. The Service may include Scripture text and other content, and we may add, change, or remove features at any time.

You must be at least 18 years old to use the Service. By using it you confirm that you are 18 or older and that you have the legal capacity to agree to these Terms. We ask you to confirm your age when you start, and we may suspend access and delete data if we learn that someone under 18 is using the Service.

You can start as a guest, and you may later link an account (Google, Apple, or email). Keep your sign-in details secure and tell us if you think someone else is using your account. You are responsible for activity on your account. Guest profiles that stay inactive for 12 months are deleted or anonymized, as described in the Privacy Policy. Linking an account is needed to subscribe.

You agree not to:

1. Use the Service for anything unlawful, or to harass, threaten, or harm others.
2. Use it to seek diagnosis, treatment, emergency help, or other professional services (see section 3).
3. Try to extract the Agent's instructions, reverse engineer, scrape, or copy the Service, or access it by automated means.
4. Interfere with or overload the Service or its security, or use it to build a competing product or train an AI model.
5. Upload or share content that is hateful, sexually explicit, or violates others' rights.
6. Misrepresent your age or identity, or let anyone under 18 use your account.
7. Share your account or resell access to the Service.

The Agent is generated by artificial intelligence. Its responses can be inaccurate, incomplete, or inappropriate, and are not guaranteed. The Agent is not a church, a clergy member, or an authoritative interpreter of any faith or doctrine, and its responses are not official teaching of any religious community. Use your own judgment and the guidance of qualified people you trust. You can report a response from within the app (see the Privacy Policy, section 5).

You keep ownership of what you write. You give us a limited, non-exclusive, worldwide license to process it only as needed to run the Service for you: to generate responses, build your Context, and operate the app, including by sending it to our AI and infrastructure providers described in the Privacy Policy. We do not use your conversations to train AI models, and we do not sell them. Don't share anything you do not have the right to share.

Anonymized data. When you delete your account, we delete what identifies you and fully anonymize what remains, as described in the Privacy Policy. Data that has been fully anonymized no longer identifies you and is no longer your personal information, so you agree that we may keep and use it indefinitely, as statistics, to understand and improve Spiritful. We do not sell it and we do not try to re-identify it.

The Service, including its software, design, text, brand, and the Agent's configuration, is owned by Breakinsoft or its licensors and is protected by law. We give you a personal, limited, revocable, non-transferable license to use the Service for your own non-commercial use. The Scripture text in the Service comes from public-domain translations. Other content, including what the Agent generates, is for your personal use only.

Spiritful has a free experience and a paid plan called Plus. During your first 7 days you have generous access, including conversations with the Agent. After that, free access continues in a more limited mode, in which the Agent responds with a short activity instead of a full conversation, and Verses remain available. Plus unlocks full conversations with the Agent and the rest of the experience. Plus is offered monthly or annually, and the annual plan may include a free trial. What is free and what Plus includes may change over time. Prices, billing period, and renewal terms are shown in the app before you purchase.

• Billing. Purchases are processed by the Apple App Store or Google Play, not by us. Your payment method is charged at confirmation of purchase.
• Automatic renewal. Subscriptions renew automatically for the same period unless you cancel at least 24 hours before the end of the current period.
• Cancel anytime in your App Store or Google Play account settings. Cancelling stops future renewals; you keep access until the end of the paid period.
• Free trial. If offered, a free trial converts to a paid subscription at its end unless you cancel before it ends.
• Refunds are handled by Apple or Google under their policies.
• Price changes. We may change prices; where required, you will be notified and given the option to cancel before the new price applies.
• Restore purchases is available in the app.

If you send us feedback or ideas, you allow us to use them without obligation to you.

You can stop using the Service and delete your account at any time in Settings, or at spiritful.app/delete-account. We may suspend or end your access if you break these Terms, if required by law, or to protect the Service or others. When your account is deleted, we delete what identifies you and anonymize the rest, as the Privacy Policy explains. Sections that by their nature should survive (such as 3, 8 (anonymized data), 13, 14, and 17) continue after termination.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICE OR THE AGENT WILL BE UNINTERRUPTED, ERROR-FREE, OR SUITABLE FOR YOUR NEEDS, AND WE ARE NOT RESPONSIBLE FOR DECISIONS YOU MAKE BASED ON ITS RESPONSES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BREAKINSOFT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, INCLUDING ANY HARM RESULTING FROM RELIANCE ON THE AGENT AS A SUBSTITUTE FOR PROFESSIONAL CARE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR US$50 IF YOU HAVE NOT PAID US. Nothing in these Terms limits liability that cannot be limited by law.

The Service relies on third parties such as Google (Gemini AI models through Google Cloud, and Firebase), Apple, and Google Play. Their terms apply to their services. Apple and Google are not responsible for the Service, and they are third-party beneficiaries of these Terms to the extent their rules require.

We may update these Terms. If a change is material, we will tell you in the app before it takes effect. If you keep using the Service after the change takes effect, you accept it. If you do not agree, stop using the Service and delete your account.

These Terms are governed by the laws of Peru, without regard to conflict-of-law rules. Disputes will be submitted to the courts of Peru, except where mandatory consumer law in your country gives you the right to bring a claim elsewhere. Mandatory consumer rights in your country of residence are not affected.
